Where a Request for Examination is filed, an examiner of the Korean Intellectual Property Office (KIPO) shall examine the patent application. The examiner shall review whether the invention satisfies :
novelty(i.e., it is new compared to prior art); and
inventive step(i.e., it is not easily derived from prior art).
In many cases, objections may be overcome by submitting a Written Response (Argument)and an Amendment. However, amendments to claims may result in a reduction of the scope of protection and therefore shall be carefully reviewed.
